1. Scope and acceptance
These Estate Agent Terms & Conditions (“Agency Terms”) apply to estate agencies, agency owners, approved managers, branches and staff using the estate agent facilities on 360parkhomes.com (the “Platform”). They supplement our Website Terms & Conditions, Seller & Listing Terms, Privacy Policy and any separately agreed paid-service terms.
When an authorised representative submits an agency application or uses an approved agency account, that representative confirms that they are entitled to accept these Agency Terms on behalf of the agency. Staff members must comply with the rules relevant to their access. These are terms for use of 360 Park Homes, not a substitute for an agency's written instructions or agreement with its own client.
2. Who we are
The Platform is operated under the trading name 360 Park Homes by Ostend Company Ltd (referred to in these Agency Terms as “360 Park Homes”, “we”, “our” and “us”).
Legal company: Ostend Company Ltd
Company number: 17533666
Registered office: 167–169 Great Portland Street, 5th Floor, London, W1W 5PF
Registered in: England and Wales
Trading name: 360 Park Homes
General contact: contact@360parkhomes.com
3. Marketplace and agency relationship
360 Park Homes is an online advertising, discovery and enquiry platform for park homes and associated businesses. 360 Park Homes is not appointed as the seller's estate agent merely because an agency advertises a property here. We do not become a party to the agency's instruction, the sale agreement, the transfer of a pitch agreement or any commission arrangement between the agency and its client.
The agency remains responsible for its relationship with the seller, any negotiations it carries out, the advice it provides and the steps required to complete a transaction. We do not independently inspect every property, certify an agency's regulatory status or guarantee any particular outcome.
4. Agency eligibility and applications
Only genuine businesses and persons with authority to represent them may apply for an estate agent account. The applicant must provide accurate details, which may include the trading name, legal entity, company number (if applicable), business address, principal contact, relevant office or branch details, website, service area and evidence of authority.
We may ask for additional reasonable information to establish the identity of the business, its representatives and its authority to advertise. False, misleading, duplicate or impersonated applications can be refused. Submitting an application does not guarantee approval or publication in the public agency directory.
5. Approval, verification and access
Agency applications may be subject to administrator review before estate agent tools are enabled. Approval is an access decision for our Platform and may be conditional on the information provided; it is not a professional accreditation, insurance guarantee or confirmation that every legal or regulatory requirement has been met.
We may periodically re-check business details or require re-verification following a material change, a complaint, security concern or suspected misuse. Agencies must promptly tell us when their legal entity, ownership, relevant permissions or principal contact changes.
6. Managers, branches and staff accounts
The approved agency's authorised manager is responsible for who can access its dashboard, create or edit listings, respond to enquiries or manage branches and team members. All staff access must be assigned to genuine authorised people using the tools and permissions available at the time.
- Each user must protect their sign-in credentials and must not share accounts or bypass access controls.
- Managers should promptly remove or adjust access when employees or representatives leave or change roles.
- Branches and staff must not present themselves as separate approved agencies, or claim authority over properties or profiles, without a proper basis.
- The agency is responsible for actions taken through its authorised accounts, subject to applicable law and any security failure caused by the Platform.
Some dashboard functions may be introduced, changed or withdrawn; permissions depend on the live features made available to that account.
7. Public agency directory and profile
Approved agencies may be eligible for a public profile in our Estate Agent Directory. Displayed information may include the agency name, branding, service areas, profile text, website or business contact details that an authorised administrator chooses to publish.
The agency must own or have permission to use its logo, photographs, testimonials, trade marks and other profile content, and must keep details accurate. Inclusion in the directory does not imply exclusivity, a 360 Park Homes endorsement, a guarantee of service quality or that we have verified every claim.
8. Standard listings and listing limits
Standard property advertisements are currently free. Under the current offering, an approved estate agency is not subject to a fixed number-of-listings cap solely because it is an estate agency. Reasonable technical, security, duplicate-content and anti-spam restrictions still apply.
Where the relevant account permission is enabled, approved agencies may add, import, edit and manage their own property advertisements without separate advance administrator approval of each one. We may review, request changes, suspend or remove any listing after publication when necessary to enforce these terms and protect users.
Free listings do not guarantee featured placement, advertising promotion, traffic, buyer enquiries or a completed sale. The current availability of free listings may change for future submissions with appropriate notice; we will not retrospectively impose a new fee for existing free listings without a lawful basis.
9. Client instructions and authority to advertise
Before listing or importing any home, the agency must have the seller's current instruction, appointment or other valid authority to market that specific property, use its content and act as an intermediary where appropriate. The agency must not suggest that an owner, manufacturer or park operator instructed it unless that is true.
When asked, the agency must provide reasonable evidence of its authority without unnecessarily uploading confidential documents to public areas. If the instruction expires, is withdrawn or changes materially, the agency must promptly update or remove the affected listing and stop presenting itself as the seller's current representative.
An agency must not claim or take over another advertiser's profile, listing or park page solely because it works in that geographical area. Any transfer of listing management must be authorised by the relevant parties and the Platform.
10. Duplicate listings and attribution
The same home may be advertised by a seller and an authorised agency, or by more than one genuinely instructed agency, where lawful and where the details remain accurate. However, the agency must not create artificial duplicates, misrepresent sole-agency status or attempt to dominate results through repeated or misleading submissions.
We may consolidate, link, limit or remove duplicate listings after considering the available evidence and relevant instructions. Assignment of a listing to a public agency profile reflects our platform records only and does not decide who is legally entitled to sale commission.
11. Accurate advertisements and material information
The agency must take reasonable steps to ensure each advertisement is accurate, current, fairly presented and contains material information that consumers need to make informed decisions. Professional advertisers must comply with relevant consumer-protection laws, including the unfair-commercial-practices provisions of the Digital Markets, Competition and Consumers Act 2024, where applicable.
Details that may be material for a park-home advertisement include the actual location and park, price, home type and condition, residential or holiday use, pitch agreement arrangements, pitch fees, site-owner commission, site rules, occupancy or age restrictions, dimensions, included goods, significant defects and material service or installation charges. Not every field applies to every home; do not guess about unknown information or conceal facts that could affect a buyer's decision.
Claims that a home is brand new, fully residential, mortgageable, available immediately, exclusive or under offer must be supportable. Updates or corrections should be made without undue delay. The Platform's ability to accept a field entry is not confirmation that the claim is lawful or accurate.
12. Park-home transactions and park rules
Transactions involving residential park homes can be governed by specific mobile-home legislation, and different procedures may apply in England, Wales, Scotland and Northern Ireland. Agency staff must identify the applicable rules for each home rather than assuming ordinary freehold or leasehold conveyancing rules always apply.
Where applicable, agencies must take account of statutory information requirements, the written statement or pitch agreement, site rules, notices and assignment procedures. For qualifying sales of residential park homes in England, a site owner may be entitled to commission of up to 10% of the sale price; this is not a commission charged by 360 Park Homes. Do not misstate a site owner's right to approve a buyer, block a sale or demand information.
See GOV.UK: Selling or giving away a park home. This is general guidance and does not resolve the obligations for an individual transaction.
13. Agency regulatory and professional obligations
Each agency is solely responsible for identifying and complying with the legal obligations that apply to its actual activities and location. These may include:
- Membership of an approved property redress scheme where legally required for residential estate agency work.
- Relevant HMRC anti-money-laundering supervision, risk assessments, identity checks, records and reporting duties where its work is within the scope of those rules.
- Accurate fee and service disclosures, written client instructions, professional diligence and appropriate handling of offers and conflicts of interest.
- Applicable data protection, electronic marketing, equality, consumer-protection, advertising and industry-code obligations.
Rules depend on the particular activity: advertising a park home does not, by itself, establish that all requirements applicable to sales of interests in land apply to that transaction. We may request evidence where proportionate but do not provide regulatory or legal advice to the agency.
Official guidance: Property redress schemes and HMRC estate agency supervision.
14. Agency fees, paid packages and renewals
Publishing a standard property listing is separate from any optional agency subscription, premium agency profile, promotion, featured listing or other paid product. The applicable price, billing period, renewal arrangements, inclusions, taxes and cancellation terms must be shown at the point of purchase or in a separately agreed order.
We do not claim that every agency account automatically attracts a monthly fee, and we do not impose an agency sales commission under these Agency Terms. Where payments are enabled, they may be handled by a third-party processor such as Stripe. Refund and cancellation rights are subject to the product terms and mandatory law; no provision here removes a right that cannot legally be excluded.
Any fee the agency charges to its client, including commission upon sale, arises from the agency's own agreement with that client and must be disclosed and administered lawfully.
15. CSV imports, photographs and content rights
Where the dashboard offers a CSV or other bulk-import tool, the agency must ensure the supplied information is complete, correctly mapped, up to date and authorised for use. Bulk imports must not contain hidden tracking links, malware, personal data unrelated to the property or content taken without permission.
The agency retains rights in its original material or those of its licensors. By uploading listing and profile content, it gives 360 Park Homes a non-exclusive, royalty-free licence to host, reproduce, format, display and promote that content in connection with operating and publicising the Platform and advertised property, for as long as reasonably necessary for those purposes. This does not transfer ownership and does not authorise us to use it for unrelated products.
Photos, videos and floorplans must fairly depict the particular home, with illustrative or digitally altered material identified where omission would mislead. The agency must have appropriate permission to use any third-party images, logos or client details.
16. Buyer enquiries and dashboard communications
The intended enquiry service allows buyers and authorised agency users to exchange messages within their authenticated 360 Park Homes dashboards. Notification emails may alert an agency to a new enquiry without including the buyer's private contact details or the enquiry's contents. Private account email addresses and phone numbers are not automatically disclosed simply because an enquiry is sent.
Agencies should access and reply to enquiries through the dashboard, ensure only authorised staff see conversations, and not misuse buyer information. Users may separately choose to display public business contact details or voluntarily share details in a conversation, in which case those details will be visible to the chosen recipients.
Messages are not a guarantee of a sale, a legal offer, a confirmed viewing appointment or a binding property contract. Do not ask buyers to share banking credentials or make unexpected payments through messages. We may access relevant records where reasonably necessary for support, safety, moderation or legal obligations as described in our Privacy Policy.
17. Response standards and buyer treatment
Agencies should respond professionally within a reasonable time, keep availability current, and treat prospective buyers fairly. They must not make misleading claims about competing offers, pressure buyers to use connected financial or legal services, discriminate unlawfully or misrepresent an offer's status.
When the agency receives an expression of interest or an offer, it remains responsible for complying with any duties it owes to its client, including the handling of offers and reporting to the seller where required. The Platform's messaging system does not replace the agency's own transaction records or legal processes.
18. Availability, under offer and sold listings
Agencies must promptly update a property as Available, Under Offer, Sold or another appropriate status wherever the live dashboard permits. A home must not be presented as currently available if the agency knows that statement would be misleading. A listing may remain publicly visible after a sale for archive or informational purposes if clearly marked sold.
Where we offer voluntary sale attribution or performance reporting, the agency must not misrepresent whether a buyer originated on 360 Park Homes, through the agency's own marketing, directly or through another source. A listing's displayed days online or enquiry count does not determine commission entitlement or establish causation of the sale.
19. Parks, park operators and ownership claims
Estate agency accounts may show listings associated with residential parks. Such association does not confer park ownership, management rights or the right to moderate public comments on that park's behalf. Only authorised park operators or other appropriately authorised account holders may claim or administer a park page through the relevant process.
Agency users must not claim to be the site owner or suggest that an agency listing is endorsed by the park, owner or manufacturer without evidence and permission.
20. Data protection, direct marketing and confidentiality
360 Park Homes processes platform data as described in our Privacy Policy. Agencies are responsible for their separate processing of customer and client information under applicable data protection law. This may involve duties as an independent controller for information collected through their own websites, published contact details, offline communications or internal customer systems.
Enquiry information obtained through the Platform may be used to respond to the relevant property enquiry and for other lawful purposes only. It must not be sold, harvested or added to unrelated direct-marketing lists without a valid lawful basis and compliance with electronic-marketing rules. The agency must handle client instructions, private conversations and security information confidentially, subject to lawful disclosure requirements.
21. Quality reviews, complaints and enforcement
We may investigate complaints, verify the basis of an instruction, ask for corrections, limit bulk imports, restrict a branch or staff account, suspend publication, remove listings or revoke agency access where reasonably necessary to prevent misuse, reduce legal risk or protect the public.
Examples include false or outdated property details, unauthorised client instructions, impersonation, duplicate-spam practices, threats, abusive enquiry conduct, misuse of private information or substantial security concerns. Where reasonable we will explain a decision and permit corrections or reconsideration. Urgent action may be taken without advance notice when justified by fraud, security or legal concerns.
Approval can be withdrawn if the agency ceases trading, loses authority over its portfolio or otherwise becomes ineligible. We do not guarantee that our review process will detect every inaccurate or unlawful advertisement.
22. Closure, expiry and transfer of accounts
An agency may request closure or changes to its profile by emailing contact@360parkhomes.com. Any outstanding contractual charges for optional paid services remain subject to their applicable order and cancellation terms. We may need to keep limited records to meet legal obligations, resolve disputes and honour information rights.
Listings and enquiries are associated with platform accounts and permissions; an agency cannot demand the transfer of another user's private messages, account information or listings without an appropriate lawful basis. Where the seller moves to another agent, we may help correct public attribution or manage a listing transfer where authorisation and technical capability permit.
23. Responsibility and liability
The agency is responsible for the accuracy, authority and legality of its own adverts, client instructions, staff conduct and buyer communications. 360 Park Homes provides the marketplace service with the obligations required by law but does not guarantee website availability at all times, search position, buyer enquiries, offers or completed transactions.
Nothing in these Agency Terms excludes or limits liability which cannot lawfully be excluded, including fraud, fraudulent misrepresentation, death or personal injury caused by negligence and any applicable statutory protection. Any additional limitations or commercial service levels applicable to a separately purchased business product must be clearly agreed in the relevant contract and remain subject to law.
24. Changes to these Agency Terms
We may update these Agency Terms to reflect changes to our services, security, relevant law or commercial arrangements. We will publish the revised terms and effective date, and will give appropriate notice or obtain renewed acceptance where required for material changes affecting existing arrangements.
These Agency Terms are governed by the laws of England and Wales, subject to mandatory laws and jurisdictional rules that cannot lawfully be excluded. Each agency must comply with any different rules applicable to its clients or operations in Scotland, Wales or Northern Ireland.
25. Linked policies and documents
These Agency Terms should be read together with the Website Terms & Conditions, Seller & Listing Terms, Privacy Policy and Cookie Policy. If a specific purchased product has separate terms, those terms apply to that product where clearly agreed. If provisions conflict, mandatory legal rights prevail.
Agencies should retain their own written seller instructions, evidence of authority, required regulatory records and independent correspondence necessary for their business.
